The European Court of Human Rights has made a judgment in the case of Reznik v. Ukraine

31.01.2025

On 23 January 2025, the European Court of Human Rights made a judgment in the case of Reznik v. Ukraine.

The ECHR found that there was a violation of Article 8 (the right to respect for a person’s private and family life) and Article 18 (an effective remedy) of the European Convention for the Protection of Human Rights and Fundamental Freedoms. In particular, the Court found that the search operation conducted at the applicant’s home by law-enforcement authorities was not accompanied by sufficient procedural safeguards and could not be justified as “necessary in a democratic society”. Furthermore, the applicant did not have access to legal remedies to complain about the unlawful acts of the police authorities, including the violation of the advocate’s right to legal professional privilege.
